Welcome to the Textainer Financial Services Litigation website.

On January 25, 2008, the Superior Court entered an order approving a partial settlement with Defendant RFH, Ltd. To view the order, follow the hyper link at the bottom of this page. This was a partial settlement that involved only one defendant, RFH, Ltd., thus the litigation with the other defendants survives this settlement.

On March 24, 2008, the Textainer Defendants filed a motion for summary judgment, an attempt to dispose of the case without trial. Plaintiffs opposed the motion and a hearing was held on June 18, 2008 at the Superior Court in San Francisco. Plaintiffs prevailed, the Court denied the Textainer Defendants’ motion, and the case will continue toward trial. A trial date has not been set.  If you held limited partnership interests in TCC Equipment Income Fund, a California Limited Partnership, Textainer Equipment Income Fund II, L.P., Textainer Equipment Income Fund III, L.P., Textainer Equipment Income Fund IV, L.P., Textainer Equipment Income Fund V, L.P., and/or Textainer Equipment Income Fund VI, L.P. (the “Partnerships”) as of January 20, 2005 (the record date for the vote to approve the sale of the assets of such Partnerships), you are a member of the class whose rights may be affected by the continuing litigation and the partial settlement.
